Property owner imprisoned over concrete jetty built in Lake Pontchartrain

One of 67 Criminal Prosecutions in Louisiana under the Clean Water Act (from 1989-2022)

The defendant in this case is an individual with property on Lake Pontchartrain. The defendant went ahead and dredged and constructed a concrete jetty and retaining wall in Lake Pontchartrain without a permit. The defendant was charged with three counts including violation of the Clean Water Act and Harbors Act.

The defendant was sentenced to eight months in prison for each of the charges, to be served concurrently. Upon release from prison, the defendant served 12 months of probation and ordered to pay a special assessment fee. No federal fine was imposed, as per the plea agreement.

Prison: three x 8 month terms, served concurrently; Special Assessment: $125; Probation: 12 months
