New York State Crime/violations for the week of July 18-24, 2022

NYS Spill Hotline 1-800-457-7362

Under State law and regulations, spills that could pollute the lands or waters of the state must be reported within 2 hours of discovery.

The Department of Environmental Conversation (DEC) recommends that anyone with knowledge, report the discovery of any contamination or a release to the NYS Spill Hotline (1-800-457-7362) as soon as possible.

Exempt from this reporting requirement: spills where ALL of the following conditions are met: spills known to be less than five gallons, contained and under control of the spiller, and will not reach water, and cleaned up within two hours of discovery.

Historic Case Summary (2004) Acid and heavy metals dumped into the Amherst, NY sewage system bring probation, restitution and a hefty federal fine

A company found to be discharging material of low pH (acidic, under 5.0 pH) and waste containing the heavy metal silver, without a permit, into the municipal publicly owned treatment works (POTW) was charged with knowingly violating the Clean Water Act. 

The company plead guilty to the violation, and was sentenced to 24 months probation, a special assessment fee of $400, $3,487 restitution to the town of Amherst, and a federal fine of $70,000.
