Clean Water Act Conviction Fiscal Year 2013; Case ID# CR_2405 (Arizona) Wastewater Facility supervisor convicted for inaccurate discharge reporting
The defendant in this case was a long term municipal employee responsible for the management and supervision of the day to day operation of the City of Casa Grande wastewater treatment plant. The defendant was charged with negligent violation of the Clean Water Act related to incomplete and inaccurate reporting of the wastewater discharges.
The defendant's supervisory duties included monitoring the daily wastewater discharge flow rate, recording and reporting, signing the records as required by the State of Arizona discharge permit. The court received information indicating multiple periods of several months duration during 2007, 2008 and 2009 where the defendant submitted inaccurate measurements of the daily discharge flow rate. In addition to the inaccurate measurements, reports were not submitted at all for six months in 2008 and 2009.
The federal district court judge sentenced the defendant to a term of probation. No fines were imposed.
