Recycling gone wrong: North Carolina waste hauler convicted for unauthorized fill of wetlands, sent to prison, with a $300,000 fine to boot

The defendant in this case is a 58 year old resident of Nashville, North Carolina, the owner and operator of a hauling company contracted to dispose of petroleum-contaminated soil.

Federal District Court in Raleigh North Carolina received a bill of information, demonstrating the defendant had been hired to remove contaminated soil from the Marine Corp Air Station New River, contracted by an environmental remediation company to handle the load-out and proper disposal in March, 2010. In May, 2010, the defendant was contacted by the manager of a Jones County farm to haul in, 50 to 60 truckloads of fill material for a low-lying area.

As it goes, the low-lying area on the farm was a protected wetland. Filling wetlands is a violation of the Clean Water Act. In this case, the sensitive habitat was not only filled, you may have guessed, that contaminated soil from the Marine Corps was not properly disposed of, it was recycled, deliberately placed back in the environment.

Sentencing of the defendant included a prison lock-up of six months, followed by a year of probation, including six months home detection with electronic monitoring. The defendant was further sentenced to a hefty financial penalty, federal fine and a payment to the North Carolina Ecogogical System Enhancement Program – Wetlands Restoration Fund.

Prison: 6 months; Home Detention: 6 months; Federal Fine: $300,000; Restitution: $11,368; Probation: 12 months
