The defendant in this case is a holding company involved in a real estate development on the shore of Lake Pontchartrain. The company did not have a permit to dredge in Lake Pontchartrain.
Investigators found the defendant had dredged and discharged the material in Lake Pontchartrain. The defendant was charged with a single count violation of the Clean Water Act, knowing violation for the dredge and discharge without permit.
The defendant entered a guilty plea to the CWA charge. Sentencing involved a federal fine plus restitution payments allocated between four environmental organizations working in and around Lake Pontchartrain, including $20,000 to Lake Pontchartrain Basin Foundation, $10,000 to the Louisiana Environmental Action Network, $5,000 to the Southern Environmental Enforcement Network and $3,000 to Keep Our Peaceful Environment.
