Environmental services company convicted for dumping waste into Potomac River

The defendants in this case are two: the owner of an environmental services company, and the corporation itself, operating in Wilmington, DC. Felony charges were brought upon the corporation, and the individual responsible for day to day operations and decisions. The case involves Clean Water Act violations impacting the Potomac River during a two week period in late May and early June of 2011.

The defendants were sub-contracted by a company performing work for the National Park Service. The work involved cleaning the storm sewer system around the National Mall. For two weeks in spring 2011, the defendants used a vac truck to pull waste from the storm water drains, catch basins and oil-water separators. A supervisor for the general contractor on site directed the defendants to unload liquid and solid waste materials cleaned from the storm sewer down a storm water drain. The waste materials flowed from the storm drain outfall into the Potomac River.

The defendants plead guilty to the CWA charges, with sentencing of the corporation including a federal fine and three years of probation. The corporation was mandated by the court to establish an environmental compliance plan. The individual defendant was sentenced to perform 200 hours of community service and subject to two years of probation.

This case was investigated by the U.S. EPA Criminal Investigation Division and the United States Park Police. Also charged and convicted in connection with this incident, the general contractor's agent. The general contractor was further charged for billing the United States for work not properly completed.

Federal Fine: $20,000; Community Service: 200 hours; Probation: 60 months
